Terms of Service

1. Agreement to Terms

By accessing or using the margin/ platform ("Service") operated by margin/ Systems AG ("Company," "we," "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

margin/ provides payment optimization tools including:

  • Commercial card detection and steering (margin/steer)
  • SEPA Instant and Open Banking promotion (margin/push)
  • FX markup detection and mitigation (margin/fx)
  • Refund optimization (margin/back)
  • Interchange downgrade prevention (margin/down)

Our services are advisory and optimization tools. We do not process payments, handle funds, or require a payment license.

3. Account Registration

To use our Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of unauthorized access
  • Be responsible for all activities under your account

4. Pricing and Payment

Our pricing model:

  • Performance-based: We charge 25% of recovered savings
  • No upfront costs: No setup fees or monthly subscriptions
  • Minimum floor: €1,500–3,000/month applies when savings exceed threshold
  • No savings = No payment: If we don't save you money, you don't pay

Invoices are issued monthly based on tracked savings. Payment is due within 30 days. See our Pricing page for details.

5. Acceptable Use

You agree not to:

  • Use the Service for illegal purposes or in violation of any laws
  • Attempt to reverse engineer, decompile, or disassemble our software
  • Interfere with or disrupt the Service or servers
  • Use automated systems to access the API beyond reasonable limits
  • Share API keys or credentials with unauthorized parties
  • Use the Service to compete with us or build competing products

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by margin/ Systems AG and protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

7. Service Availability and SLA

We strive for:

  • 99.99% uptime SLA for API availability
  • 50ms latency guarantee for BIN detection
  • 24/7 monitoring and incident response

We may perform scheduled maintenance with advance notice. We are not liable for downtime due to factors beyond our control.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We process data in accordance with GDPR and applicable data protection laws.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

  • Specific savings amounts or ROI
  • 100% accuracy of BIN detection or classification
  • Uninterrupted or error-free operation
  • Compatibility with all payment processors or systems

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, or consequential damages
  • Loss of profits, revenue, or data
  • Business interruption or loss of goodwill

Our total liability shall not exceed the fees paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless margin/ Systems AG from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights.

12. Termination

Either party may terminate this agreement:

  • By you: Cancel your account at any time via dashboard
  • By us: With 30 days notice, or immediately for breach of Terms

Upon termination, your access will cease, but you remain responsible for fees incurred prior to termination.

13. Governing Law

These Terms are governed by the laws of [Jurisdiction], without regard to conflict of law principles. Any disputes shall be resolved in the courts of [Jurisdiction].

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent website notice. Continued use after changes constitutes acceptance.
